Battle of the Sexes

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.

1. HOW TO ENTER

a. The Battle of the Sexes contest will take place each weekday (except for holidays) beginning on July 18th, 2006 at about 6:40am until a date to be determined by WOMX-FM (the “Station”)

b. To participate in the contest, you may enter via the following method: Listen to WOMX for the cue to call and be the fifth caller at 407-919-1051 or 1-877-919-1051 after the cue to call is announced. If the fifth caller is a male, he will be placed on hold and Scott & Erica will take the next caller continuously until a female caller is found. If the fifth caller is a female, she will be placed on hold and Scott & Erica will keep taking consecutive calls until a male caller is found. The female caller and the male caller will participate in the Battle of the Sexes game. Scott & Erica will alternate who goes first each day – the male or the female. Each participant will be asked three multiple choice questions based on the opposite sex. Each will have five seconds to answer the question. For example, the male may be asked “What manufacturer makes a certain brand of lipstick?” The participant who answers the most number of questions correctly will win the contest prize, upon confirmation of contest eligibility.
c. In the event of a tie, Scott & Erica will ask a general knowledge question. If a participant thinks they know the answer, they need to say their name. Once Scott & Erica acknowledges them, then he/she can give the answer. If he/she is correct, then he/she will the contest prize. If the answer is incorrect, then the other participant will win the contest prize. If for the tie breaker, the participants say their name at the same time, then Scott & Erica will repeat the tie-breaker procedure until a winner is determined. For the tie-breaker, if a participant yells out an answer before giving their name and/or being acknowledged by Scott & Erica then he/she will be eliminated and the other participant will win the contest prize.

d. The Station is not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call.

2. ELIGIBILITY RESTRICTIONS

a. The contest is open to all WOMX listeners who are 18 years of age or older and who legally reside in Orlando listening area. Employees of WOMX, its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Orlando metropolitan area and the members of their immediate families [AND/OR HOUSEHOLDS] are ineligible to participate or win.

b. Only one winner per household is permitted in any Station contest every 60 days.

c. Winner must have a valid photo ID such as driver’s license or passport in order to claim prize at the MIX business office.

3. PRIZES

a. One contest prize will be awarded each weekday (except for holidays). The contest prize will vary each week of the contest, and may consist of one of the following items: one CD, one DVD, one gift certificate, two (2) concert tickets (to an event to be selected by the Station) or prize pack. Prizes will be awarded based on availability and solely at the discretion of the Station upon verification of winner eligibility.

b. All prizes or prize certificates may be picked up at the office of the Station at the address below. The winner will forfeit any prize or prize certificate not claimed within thirty (30) of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.

c. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.

4. WINNER SELECTION AND NOTIFICATION

a. Decisions of the Station management with respect to the contest are final.

b. Prize winners will be selected in the manner described in Section 1b of these rules.

c. Odds of winning depend on the number of calls received.

d. Winner needs to be listening to WOMX to participate and win.

e. Winner will be announced live on the air. Winners must execute and return any required Affidavit of Eligibility/Release of Liability Prize Acceptance Form within thirty (30) days of notification attempt or prize will be forfeited and become property of WOMX-FM.

5. CONDITIONS

a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent.

b. By participating in the contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.

d. The Station reserves the right to make changes in the rules of the contest, including the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.

e. Failure to comply with the contest rules may result in a contestant’s disqualification solely at the discretion of the Station.

f. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of a prize.

g. Copies of the written contest rules and a list of winners (when complete) are available during regular business hours at the main studio of WOMX-FM, 1800 Pembrook Drive, Suite 400, Orlando, Florida, 32810.
