Fact or Fiction

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.

1. HOW TO ENTER

a. The WOMX “Fact or Fiction” contest will take place each weekday (except for holidays) beginning on January 1st, 2006 at about 8:40am until a date to be determined by WOMX-FM (the “Station”).

b. To participate in the contest, you may enter via the following method: Listen to WOMX during the contest period for the cue to call and be the designated caller to 407-919-1051 or 1-877-919-1051. If a champion has not yet been chosen, WOMX will take callers number 10 and 11 to play the “Fact or Fiction” game. If a champion has been chosen, then WOMX will take caller number 10 to challenge the existing champion. Champion will decide if he/she will answer the questions first or if the challenger will go first. If a champion has not yet been chosen, then the contestants will go in the order that they called in (caller #10 and then #11). Contestants will be asked three (3) questions and will have five (5) seconds to state “fact” or “fiction” in response to each question (i.e. true or false). If a question is not answered within the five (5) second period, the answer will be deemed invalid and no points will be awarded. The contestant who answers the most number of questions correctly will win.

c. In the event of a tie, contestants will go to a tie-breaker round, in which both contestants will be given one question to answer within five (5) seconds. The first contestant that answers the tie-breaker question correctly will win. If a contestant does not answer the tie-breaker question, then he/she will be eliminated and the other contestant will win. In the event a tie remains, there will be subsequent tie-breaker rounds until one winner is selected.

d. The Station is not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call.

2. ELIGIBILITY RESTRICTIONS

a. The contest is open to all WOMX listeners who are 18 years of age or older and who legally reside in Orlando listening area. Employees of WOMX (the “Station”), its licensee, its corporate parents, subsidiaries, and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Orlando metropolitan area and the members of their immediate families [AND/OR HOUSEHOLDS] are ineligible to participate or win.

b. Only one winner per household is permitted in any Station contest every 60 days.

c. Winner must have a valid photo ID such as driver’s license or passport in order to claim prize at the MIX business office.

3. PRIZES

a. “Fact or Fiction” game winners will win $20 for each day that they play and win. Winners will have the option to play again the day after winning for an additional $20, or to retire after winning and receive their accumulated winnings. If a winner chooses to play again the next day and loses that game, the winner will lose his/her accumulated winnings, which will be awarded in their entirety to the winning contestant.

b. WOMX-FM will mail a check for the winner’s prize to the winner’s home address (as provided) in 4-6 weeks.

b. All prizes or prize certificates may be picked up at the office of the Station at the address below. The winner will forfeit any prize or prize certificate not claimed within thirty (30) of winning.

c. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.

4. WINNER SELECTION AND NOTIFICATION

a. Decisions of the Station management with respect to the contest are final.

b. Winners will be selected in the manner described in Sections 1b and 1c of these rules.

c. Odds of being a contestant depend on the number of calls received.

d. Winner needs to be listening to WOMX to win.

e. Winner is declared live on the air. Winners must execute and return any required Affidavit of Eligibility/Release of Liability Prize Acceptance Form within thirty (30) days of notification attempt or prize will be forfeited and become property of WOMX-FM.

5. CONDITIONS

a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent.

b. By participating in the contest, the winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.

d. The Station reserves the right to make changes in the rules of the contest, including the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.

e. Failure to comply with the contest rules may result in a contestant’s disqualification solely at the discretion of the Station.

f. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of a prize.

g. Copies of the written contest rules and a list of winners (when complete) are available during regular business hours at the main studio of WOMX-FM, 1800 Pembrook Drive, Suite 400, Orlando, Florida, 32810.
